Vast legal rights and protective measures are in place for children with autism. As a parent or individual with autism, it’s advantageous to have a thorough understanding of these legal rights and protective measures to ensure fair treatment and access to all necessary services and support for your child.

Public and charter schools in Nevada

The most recent legislation, SB174, outlines specific requirements for public and charter schools to follow in order to adequately meet the needs of students with autism. It orders schools (working with ASD children) to have their board to develop policies that outline the terms in which students with ASD, who have personalized education plans, will receive medically necessary treatments.

In other words, a policy must be in place to allow medical insurance providers, third-party payors, or any other party paying for a child’s treatment to do so in the event of consent from parents or legal guardians.

Besides, SB174 also seeks to redefine the term “volunteer” to guarantee that individuals who may have unsupervised interactions with students, such as private instructional personnel, are subjected to background checks and fingerprinting procedures.

In case you are wondering how the fingerprinting will be carried out, in the case of a charter school, the governing body of the school, or in the case of a public school, the board of trustees of the district, will be responsible for conducting these checks.

Autism

For many who are not familiar with autism, it can be easy to think of its challenges as just something that will go away with time. However, it’s worth noting that autism is a lifelong developmental disability that affects individuals in various ways.

It is a complex neurological condition that impacts communication, social interaction, and behavior. Families’ biggest challenges as far as Autism and school are concerned are navigating the legal system to ensure the Child’s rights are protected in schools.

This is where laws like SB174 come into play, safeguarding the rights of students with ASD. That said, the current rate of autism diagnosis is alarming, with 1 in 54 children being diagnosed on the autism spectrum. This means that there is a growing need for proper education and support systems for individuals with ASD to thrive in society.
